On July 25, 1995, an amended eight-count information was filed against appellant Kelly Jon Landis. Counts 1 and 2 charged appellant with stalking in violation of Penal Code section 646.9, subdivision (b). Counts 3 and 4 charged appellant with first degree residential burglary in violation of Penal Code section 462, subdivision (a). Counts 5, 6, and 8 charged appellant with second degree vehicular burglary in violation of Penal Code section 459. Finally, count 7 charged appellant with receiving stolen property, in violation of Penal Code section 496, subdivision (a). Appellant pleaded not guilty.
Trial by jury commenced on July 31, 1995. On August 14, 1995, the trial court determined that the jury was deadlocked on counts 1 and 2, and declared a mistrial as to these counts. On the same date, the jury found appellant guilty on counts 3 through 8.
On October 24, 1995, appellant was sentenced to prison for a term of six years, including a four-year sentence as to count 3, a sixteen-month sentence as to count 4, and an eight-month sentence as to count 7, to run concurrently with eight-month sentences as to counts 5, 6, and 8. This appeal followed.

In March, 2004 legendary AIDS activist, David Pasquarelli died following health problems caused by being jailed. [DavidPasqarelli.com] He had been arrested on November 28, 2001, and imprisoned for 72 days in the San Francisco County Jail for charges related to his political activities. San Francisco authorities had used 'terrorism' laws and outlandish multi-million dollar bail to try shut David up about the corruption of AIDS Inc. David Pasquarelli and Michael Petrelis were held on $500,000 bail each. Both had come to Superior Court for a hearing on civil harassment suits by two public health officials and five Chronicle reporters and editors, all allegedly the targets of threatening telephone calls. They were arrested in a hallway after the hearing. Pasquarelli is a member of ACT UP/San Francisco, a group that has clashed with mainstream AIDS organizations over its belief that AIDS is not caused by HIV. He and other members have been convicted of disturbing the peace for disrupting public health meetings and throwing objects at officials, but yesterday's felony charges, punishable by a sentence of as long as three years in prison, raised the stakes considerably. Michael Bellefountaine, another member of ACT UP/San Francisco, called the courthouse arrests a "cowardly ambush" and described the charges and hefty bail as "overkill meant to deny them their liberty, to punish them for aggravating some influential people in the city." Two city health officials, Dr. Jeffrey Klausner, director of sexually transmitted disease prevention, and Michael Shriver, Mayor Willie Brown's AIDS adviser, also reported receiving similar calls from both men. Shriver said he stopped staying at his home after a threatening message from Pasquarelli.

"If the [drug companies] do not respond positively to our demands [we] will intensify the struggle and put pressure on the pharmaceutical companies by involving our communities in consumer boycotts and forcefully entering all the premises of pharmaceutical companies," group leader Thanduxolo Doro said.

It's quite simple -- people who do any sort of direct action political activism are always targeted by the government for criminalization.
You're wasting your time going after a handful of dissidents. As soon as you start researching the arrest records of the non-dissident ACT UP members across the country, you'll see many more criminal records amongst them than all the dissidents combined.
One time, non-dissident "ACT UP" members invaded and violently took over several prime-time news casts as they were airing live, what about the non-dissident attack of peaceful worshipers at St. Patrick's cathedral? "ACT UP" surrounded and violently attacked the vacation home of Bush the first, and these same non-dissident people going by the name of "ACT UP" also took over drug labs in Boston, using violence to intimidate the government into deregulating the FDA. That deregulation has led to many deaths of people who don't even have AIDS because toxic drugs for their illnesses were released without adequate testing. My father-in-law died from one of those diabetes drugs that would have never been put out on the market without adequate testing if it hadn't been for those drug pushing non-dissident "ACT UP" drug pushers!
These drug pushers are the real bad ones! They've murdered countless people in the United States thanks to their violent tactics intimidating the government into deregulating the FDA!
